1. MANDATORY APPLICATION
Everyone who cooperates with philanthropy.gr ltd., compulsorily and automatically accepts and is subject to these Terms of Service. This text is an explicit Agreement between the company philanthropy.gr ltd. and the Customer. Along with these Terms of Service, our “Privacy Policy” our “Terms and Conditions” and our “Legal Notice” also apply. Everyone who does not accept these Terms shall not cooperate, communicate or make trasnactions with philanthropy.gr ltd.
2. GENERAL COOPERATION TERMS WITH CUSTOMERS
2.1 We follow the standard rules of the market and the Common Ethics. In any case, responsible for resolving any dispute are the courts closer to the headquarters of Philanthropy.gr ltd.
2.2 Philanthropy.gr ltd. communicates and is officially expressed by the Corporate e-mail address info@philanthropy.gr, the email address of the Managing Director nikolas@philanthropy.gr and the e-mail address info@rotrexshop.com.
2.3 The Customer communicates and is officially expressed by sending e-mail to any official e-mail address of philanthropy.gr ltd.
2.4 All communications with other electronic addresses do not express philanthropy.gr ltd. nor negate terms or agreements which are based on communications with the Corporate e-mail address info@philanthropy.gr, the email address of the Managing Director nikolas@philanthropy.gr and the e-mail address info@rotrexshop.com. Exceptions are messages sent from the Managing Director e-mail nikolas@philanthropy.gr, which prevails in all communications for agreements.
2.5 The Customer is obliged to provide an electronic address that is active, and the messages sent to it are read regularly. If the Customer does not receive or does not read messages sent to the email address provided for communication, Philanthropy.gr ltd. cannot be held responsible.
2.6 For all products, the payment must be made prior to the delivery of the goods, by deposit/transfer to a Bank Account of Philanthropy.gr ltd. or by Credit/Debit Card.
2.7 Philanthropy.gr ltd. is able to provide services 24 hours, 365 days a year. However, for working off the normal office hours, an increase in price applies, depending on the occasion, upon agreement.
2.8 The normal office working hours of philanthropy.gr ltd. is 9:00 to 17:00, Athens, Greece local time, unless another Office Hours time period is published on the contact page on Philanthropy.gr ltd’s website, at www.philanthropy.gr.
2.9 The prices and amounts mentioned always refer to the net value and do not include VAT or other taxes if applicable.
2.10 If the Customer chooses a payment method that requires extra charges or fees, these fees are paid by the Customer.
2.11 If the location or legal status of the Customer means additional fees such as Customs will be added to the order, these fees are paid exclusively by the Customer.
2.12 Payments are made by deposit or transfer to the Bank Accounts of philanthropy.gr ltd. or by Credit/Debit Card. Cash is not accepted.
2.13 A payment is considered completed, when the amount has been completely and definitely received by Philanthropy.gr ltd. and is free from any restriction.
2.14 The prices and features may change without warning. Anytime, the valid prices and service features are those presented in the e-shop.
2.15 Philanthropy.gr ltd. reserves the right to discontinue cooperation with any Customer at its discretion and without obligation to provide reasons.
2.16 The Customer reserves the right to discontinue cooperation with Philanthropy.gr ltd. at his/her discretion and without obligation to provide reasons.
2.17 All times, dates, units, currencies etc. on all services, transactions etc. are defined by Philanthropy.gr ltd. Usually, they are the ones used in Greece.
3. DETAILS ON TERMS OF SERVICE
3.1 In case of disagreement between us concerning the interpretation of the Terms of Service, the reasoning and the expressed decision of Philanthropy.gr ltd. prevails.
3.2 You agree to each one of the following: obey the applicable laws and the Acceptable Use Policy, take reasonable security precautions in using the Products, collaborate with Philanthropy.gr ltd. to research potential problems and perform the waranty process according to the manufacturer’s directions.
3.3 If any payment dispute occurs, and Philanthropy.gr ltd. takes legal action to collect payment or involves a payment collection company, you must also pay the reasonable costs Philanthropy.gr ltd. paid for the collection of payment, including attorney’s fees and costs. All fees listed are in Euro. Charges not questioned within thirty (30) days of the date communicated are considered accurate and final.
3.4 The Customer is solely responsible for the suitability of the selected product. The Customer must carefully select the right product.
3.5 All product photos are indicative and may differ from the actual products currently available. Only genuine products available from Rotrex manufacturer are sold from rotrexshop.com and product photos present only these products. However, Rotrex manufacturer may change specifications or supplier and a product currently available could be different from the product that was available when product photos were taken. In any case, the current product is genuinely sold by Rotrex manufacturer and the customer accepts the current product. The client is solely responsible to verify the suitability of the products currently available.
3.6 The buyer is solely responsible for understanding the regulations and laws that apply to the purchase and usage of the products sold by philanthropy.gr ltd.
3.7 Each of us agrees not to use the Confidential Information of the other, but in the extent necessary for the provision or use of the Services, as applicable, or the exercise of our respective statutory rights under this Agreement, or as required by law. Each of us agrees not to disclose Confidential Information of the other to any third party, except as follows:
(i) to service providers, sellers, and agents, provided that such service providers, vendors, dealers have agreed to confidentiality measures that are at least as stringent as those set out in this Agreement.
(ii) to law enforcement agencies or the government if required by subpoena or other compulsory legal process, or if one of us believed, in good faith, that the behavior of the other may violate any applicable criminal law, as required by law.
(iii) in response to a subpoena or other compulsory legal process.
3.8 Our obligations to you are defined by this Agreement. We are not responsible to you for the non-provision of our Services.
3.9 None of us (or our employees, agents, partners or suppliers) can be held liable to the other for any lost profits or any indirect, special, incidental or consequential loss or damage of any kind, or any damage that could have been avoided by due diligence, even if the person responsible for the damage has been advised or should be aware of the possibility of such damages. Under no circumstances should any of us be liable to the other for any compensation.
3.10 Notwithstanding anything in the Agreement to the contrary, the maximum aggregate liability of Philanthropy.gr ltd. and its employees, representatives, suppliers, partners, and any act or omission relating to the Services or the agreement under any law ( including breach of contract, tort, strict liability, breach of law, and infringement) shall not exceed the total amount of 100 (one hundred) euros.
3.11 If we, our affiliates, or any of us or their respective employees, agents, or suppliers, are confronted with a legal claim from a third party resulting from your own actual or alleged gross negligence, willful misconduct, violation of the law, not fulfill security obligations required under the Agreement, violation of these Terms of Service, then you only will pay the cost of defending the claim (including reasonable attorneys’ fees) and damages, fines, or other amount imposed on Philanthropy.gr ltd. as a result of the claim. We will choose a lawyer to defend the claim. You must comply with our reasonable requests for assistance and cooperation in defending against any claim. You must pay the costs payable under this section if they arise.
3.12 We can change the Terms of Service at any time, provided that any changes are reasonable and consistent with applicable law and industry standards. All these changes made during the course of your Agreement will take effect in your account immediately. If a change substantially and adversely affects you, you may terminate the Agreement by giving us written notice of termination on these grounds no later than thirty (30) days from the date on which the change entered into force.

3.14 Philanthropy.gr ltd. will contact you via e-mail, to the e-mail address and the person you designate as your contact for your account. Messages deemed to be received by the time of their submission.
3.15 Communications can be made in Greek or English language.
3.16 You may not use the Products in any situation where failure or fault of the Products could lead to death or serious injury to any person, or in physical or environmental damage. For example, you can not use, or allow any other person to use the Products in connection with aircraft or other means of public transportation of people, nuclear or chemical facilities, or other medical facilities.
3.17 Neither of us will be deemed to have contravened the agreement, for the non-fulfillment of an obligation due to an event beyond our control, such as a major weakness of part of the electricity system, significant failure of the Internet, natural disaster, war, riot, epidemic, strikes or other organized labor action, terrorism, or other events of the size or type for which precautions are not generally taken in the industry.
3.18 This agreement is governed by the laws of Greece. Each of us agrees that any dispute or demand, including without limitation, claims, statutory, contract or tort related to or arising out of this agreement or alleged breach of this Agreement shall, upon timely written request be done by out of court resolution. You and we hereby waive any right to a judicial authority, so that differences can be resolved out of court. We both agree that we will not raise claims against each other after thirty (30) days from the day on which one of us believed the agreement has been violated.
3.19 These Terms of Service apply as posted here at any given time.
3.20 In case there is a discrepancy between the English and the Greek text of these Terms of Service, the English text prevails.
3.21 The website rotrexshop.com is owned and operated by philanthropy.gr ltd.
4. WARRANTY
4.1 The warranty for the Rotrex products is offered by the manufacturer, Rotrex A/S, and it is subject to special conditions. The warranty process inspection and compensation is implemented through a customized, manufacturer-driven process. The customer agrees to cooperate and comply with the manufacturer requests in order to perform all necessary actions for the warranty claim to be performed.
4.2 The warranty applies exclusively to Rotrex products and does not cover transportation costs, shipping costs, or any other costs. Rotrex does not accept consequential damages of any kind. The maximum claim amount is limited to the purchase price of the Rotrex products.
4.3 The decision on a warranty claim is the sole authority of the manufacturer, Rotrex A/S. The customer agrees to accept this term and the manufacturer’s decision on a warranty claim.
4.4 Rotrex offers 12 months warranty from Rotrex shipment date with the possibility to extend up to a total of 36 months on the following terms:
4.4.1 The supercharger must have been installed and used according to the Rotrex specifications.
4.4.2 By default, warranty period starts from shipment date from Rotrex warehouse.
4.4.3 Within the first 6 months from shipment date from Rotrex warehouse, the warranty starting date can be updated to date of purchase by your customer/end user, on the condition that the purchase is documented in a formal invoice including date of purchase and Rotrex supercharger serial number.
4.4.4 A Rotrex standard Customer Claim Form and photographs of the supercharger with serial number clearly shown must be emailed to claims@rotrex.com within 4 working days.
4.4.5 After having studied the photos Rotrex will advise whether the supercharger should be returned immediately to Rotrex Denmark for inspection or if other actions are required.
4.4.6 Superchargers that do not require immediate return must be kept and returned to Rotrex Denmark when requested by Rotrex.
4.4.7 Shipping from the customer to Rotrex is covered by the customer.
4.4.8 If the claim is accepted by Rotrex:
a) Rotrex issues a credit note for the claim at the current price including shipping costs from Rotrex to the customer.
b) The customer orders a new supercharger if needed (or uses a supercharger from stock and waits until next normal order)
4.4.9 All superchargers returned to Rotrex for warranty inspection remains at Rotrex and will not be returned.
4.4.10 The customer and Rotrex are both expected to cooperate in good faith to establish the cause of the claim and, if applicable, to come up with constructive solutions to rectify the underlying problem. Rotrex may reduce the warranty period on superchargers used for specific applications. Any use for racing is not covered by warranty.
Rotrex do not accept consequential damages of any kind. The maximum claim amount is limited to the purchase price of the Rotrex products.
4.5 Rotrex offers extended warranty on a supercharger head unit, extending the standard period of 12 months to a total of 36 months. Extended warranty fee will be fixed to the unique supercharger serial number. The extended warranty fee is listed in the current price list. Extended warranty cannot be transferred to another serial number.
4.6 Rotrex may reduce the warranty period on superchargers used for specific applications. Any use for racing is not covered by warranty.
4.7 Rotrex superchargers cannot be repaired.
5. ORDERS
5.1 All Rotrex products that appear as in stock in our e-shop, are available for immediate shipping. Usually this is within 24 hours during working days from the time an order and its payment have been received.
5.2 Due to special warranty policies, Rotrex Superchargers are not in stock. All orders for Rotrex Superchargers are forwarded to the production line and there is usually a waiting time around 4 days, before a shipment can take place.
5.3 The customer accepts the waiting time that is necessary for an order to be completed. Philanthropy.gr ltd. has no power in changing the time or pace of Rotrex production and therefore is limited to taking quick actions in the communicating with the manufacturer. A delay from the manufacturer is beyond our control.
6. REFUNDS
6.1 Refund to the Customer is not possible, for products with special warranty policies, such as Rotrex superchargers. Rotrex superchargers have a strict warranty policy that they must be installed on a vehicle within 6 months from the date of manufacturing. Also, all Rotrex products have no sealed package. Therefore, refunds are not possible. All purchases are final and irreversible.
7. SHIPPING
7.1 Philanthropy.gr ltd. uses only recognized companies for shipping orders. At the time of writing these terms, we use DHL for all international shipments.
7.2 Rotex supercharger KITs are ordered to the manufacturer for every customer order and they are always back-ordered in our e-shop. This means there is a waiting time. At the time of writing these terms, the waiting time is around 4 days. Other items that are available on back-order, my need up to 4 weeks to be delivered by the manufacturer. The customer agrees to wait until the manufacturer delivers the order. Items presented as in stock, are usually shipped within 24 hours from the receipt of the payment.
7.3 Philanthropy.gr ltd. will provide proper packaging for all orders, consistent with industry standards, in order to secure the contents of the package.
7.4 Philanthropy.gr ltd. will provide proof that an order has been shipped to the customer, as well as a tracking number for the order. The shipping company used, provides the tracking number.
7.5 Philanthropy.gr ltd. requests insurance coverage for all shipments, for the complete value of the order, unless the customer will choose otherwise. There may be destinations for which this is not possible, at the time of the order, due to policy changes with the transportation company or third parties involved. The client may ask if his/her location is covered by insurance for the shipment, prior to a specific order. If the transportation company we use does not offer insurance, but another transportation company offers insurance, the shipping costs may need to be adjusted.
7.6 Philanthropy.gr ltd. does not offer insurance for the shipment directly to the client in form of cash. The transportation company offers the insurance, and has the full responsibility for the proper shipment of the order and for the compensation. In case of theft, damage, loss, delay or other shipment error, Philanthropy.gr ltd. will file a claim to the transportation company. The customer agrees to wait until the transportation company finishes the claim process, and to accept the outcome of this process.
7.7 Orders are shipped at the customer’s risk of theft, damage, loss or delay. Philanthropy.gr ltd. has no liability to compensate the customer for errors of third parties involved in the shipment of an order. In any case of any theft, damage, loss or delay of an order, we will put all efforts and take all possible actions against the transportation company, in order to receive a compensation that we will pass to the customer as a refund or as a new shipment, after we have received a compensation.
7.8 The customer may arrange the pickup of the order with a transportation company of their choice and ensure the order shipment at his/her discretion.
7.9 For shipments of orders that contain KIT’s, which are shipped from Denmark, the usage of a DHL service may not be possible. The shipment from Denmark may use a different transportation company from time to time. Thus, an order of a KIT may be shipped with another company, depending on the availability of services, even if the website presents only DHL services. In any case, the corresponding service of another transportation company will be used, and the delivery time will be reciprocal to the shipping service that has been chosen by the customer.
8. CANCELLATIONS
8.1 Philanthropy.gr ltd. has the right to cancel or deny an order at its discretion and without obligation to provide reasons. If a payment has been processed, a refund will be provided. Usually, this may happen if a mistake or fault is discovered with prices, features or product availability. The customer accepts the refund and has no claims of any kind.
8.2 A customer has the right to cancel or deny an order at her/his discretion and without obligation to provide reasons, if an order has not be shipped yet. In case an order has been shipped, the refund policy clearly mentions that a refund is not possible, therefore cancellation is not possible.
8.3 An order may not be cancelled if the order has already been shipped.
